TERMS OF SERVICE
ARTICLE 1: REGISTRATION
1.1 These General Terms and Conditions apply to all agreements with The Pilates Concept.
1.2 The services of The Pilates Concept consist of giving Pilates and sports lessons. The lessons consist of different Pilates concepts, private/duo lessons and small group lessons both offline (at stated location) and online using our on demand workout library. In addition, pre-recorded Pilates and Pilates inspired videos are available on the The Pilates Concept website and via Bsport.
1.3 In order to follow The Pilates Concept’s classes/videos, one needs to be registered with The Pilates Concept via Bsport, after which one disposes of an Bsport account. After registration one can purchase a single lesson, lesson card or take out a subscription, after which one can register for The Pilates Concept’s offline and online classes and/or pre-recorded workout videos, all in accordance with the conditions of the lesson card or subscription concerned.
1.4 Lesson cards and subscriptions are strictly personal and non-transferable.
1.5 Without prior payment, participation in a lesson is not allowed or possible.
1.6 It is not possible to cancel a class card or subscription before the set term and a refund is not possible.
ARTICLE 2: LESSON CARDS
2.1 The lesson card is valid for the number and type of lessons indicated at the time of purchase.
2.2 Lesson cards are valid for the period stated at the time of purchase and are not automatically renewed.
2.3 Payment of lesson cards takes place by means of iDeal. On request payment can be made in cash, with pin or by bank transfer. Invoices can be viewed in the participant’s Bsport account.
2.4 When the participant decides not to participate in the lessons during the validity of the lesson card or subscription, refunds of lesson fees or subscription costs are not possible.
ARTICLE 3: SUBSCRIPTIONS / Memberships
3.1 Subscriptions provide unlimited access to on-demand sports videos and are automatically renewed until further notice. After the first term, subscriptions may be
cancelled monthly. The notice period is one month.
3.2 All features, benefits and conditions associated with the subscription are valid within the specified subscription period.
3.3 Payment of subscriptions is exclusively on the basis of direct debit/SEPA. The first payment is made via iDeal and immediately serves as authorization for the direct debit for the following months. Invoices can be viewed in the participant’s Bsport account.
3.4 When purchasing a subscription, unlimited access to the on demand sports videos will be granted until the end of the cancellation period.
3.5 The subscriber will choose the start date of the subscription. If the start date is on or after the 15th day of the month, or the stop date is on or before the 14th day of the month, the monthly rate will be halved that month.
ARTICLE 4: RESERVATION, CANCELLATION AND RESCHEDULING OF LESSONS
4.1 Booking and cancelling private lessons and duo lessons is done exclusively by e-mail or telephone.
4.2 Cancellation or rescheduling of private and duo lessons is possible up to 24 hours prior to the lesson. Lessons can be made up or rescheduled free of charge, provided this takes place no later than 24 hours prior to the lesson, within the validity of the lesson card, or within the relevant subscription month.
4.3 If a cancellation is made within 24 hours prior to the reserved lesson, the lesson will be deducted from the number of lessons within the validity of the lesson card or from the lesson credit for the relevant subscription month.
ARTICLE 5: PUBLIC HOLIDAYS AND PAUSES
5.1 The Pilates Concept is closed on public holidays for offline training. Private or duo lessons that are cancelled due to this may be caught up within the validity of the lesson card or the respective subscription month. The on demand workout library is 24/7 open and available to those with a subscription/membership.
5.2 In the event of illness, pregnancy or injury of a participant, a lesson card or subscription may be paused for a minimum of one month and a maximum of six months. The participant must submit a medical declaration from a doctor for this purpose.
5.3 A subscriber can pause the subscription once every six months for a minimum of two weeks and a maximum of four weeks. The break must be requested by email at least one month before the start of the break.
ARTICLE 6: LIABILITY
6.1 The lessons and sports videos are at the risk and responsibility of the participants.
6.2 Participants must adequately inform their The Pilates Concept instructor prior to the lesson about their health and physical condition and about any changes therein.
6.3 The Pilates Concept excludes all liability for damage, and/or personal injury to a participant, including possible consequential damage, incurred during or as a result of the lessons. This includes damage caused by the actions of The Pilates Concept’s auxiliary staff.
6.4 The Pilates Concept shall not be liable for loss and/or damage to property of participants.
6.5 Should The Pilates Concept nevertheless be liable, liability shall be limited to the amount paid out by the company accident insurance of The Pilates Concept.
ARTICLE 7: OTHER
7.1 The Pilates Concept reserves the right to make changes to these General Conditions. The change will take effect on purchase of a new lesson card or renewal of a membership.
7.2 The Pilates Concept reserves the right to cancel lessons, change the class schedule, lesson cards, memberships and adjust prices. In principle, lessons cancelled by The Pilates Concept may be made up.
